1. Agreement to Terms

Welcome to Traveler! These Terms of Use ("Terms") constitute a legally binding agreement between you ("you" or "User") and wareOne LLC, doing business as Traveler ("Traveler," "we," "us," or "our"), governing your access to and use of the Traveler website, mobile application, and related services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

Traveler is a route-aware weather platform that provides AI-generated briefings, National Weather Service (NWS) gridded forecasts and active alerts, animated RainViewer precipitation radar, and truck-driver-oriented hazard scoring along a driver's planned Mapbox route. Our Service combines publicly available meteorological data with Mapbox routing and presents it in a user-friendly format.

Current Coverage: All 48 states of the continental United States.

3. Eligibility

To use the Service, you must be at least 13 years of age. If you are between 13 and 18 years of age, you represent that you have your parent's or legal guardian's permission to use the Service.

By using the Service, you represent and warrant that you meet these eligibility requirements and have the legal capacity to enter into these Terms.

4. Account Registration

Some features of the Service require you to create an account. When you create an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms or for any other reason at our sole discretion.

5. Subscriptions and Payments

5.1 Free Trial

We may offer a free trial period for new users. At the end of the trial, you will be charged unless you cancel before the trial ends. Trial eligibility is determined by us at our sole discretion.

5.2 Subscription Plans

Paid features require a subscription. By subscribing, you authorize us to charge your payment method on a recurring basis (monthly or annually, depending on your chosen plan) until you cancel.

5.3 Billing

All payments are processed securely through Stripe. You are responsible for keeping your payment information current. If payment fails, we may suspend your access to paid features.

5.4 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. We do not provide prorated refunds for partial billing periods.

5.5 Price Changes

We may change subscription prices with at least 30 days' notice. Price changes will apply to the next billing cycle after the notice period. Continued use after a price change constitutes acceptance of the new price.

5.6 Refunds

Refunds are generally not provided except where required by law. If you believe you are entitled to a refund, please contact us at support@511.travel.

6. Acceptable Use

You agree to use the Service only for lawful purposes. You will not:

  • Violate any applicable laws, regulations, or third-party rights
  • Use the Service for any illegal or unauthorized purpose
  • Interfere with or disrupt the Service or servers connected to the Service
  • Attempt to gain unauthorized access to any part of the Service
  • Use automated means (bots, scrapers, crawlers) to access the Service without our written permission
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Remove, alter, or obscure any copyright, trademark, or proprietary notices
  • Impersonate any person or entity or misrepresent your affiliation
  • Collect or harvest any information from the Service or other users
  • Use the Service in a manner that could damage, disable, or impair the Service
  • Share your account credentials with others
  • Resell or redistribute the Service without our written consent

7. Important Safety Disclaimer

CRITICAL SAFETY NOTICE: The weather, alert, and hazard information provided by Traveler is for informational purposes only. Always exercise your own judgment and follow official traffic signs, signals, and instructions from law enforcement or transportation officials.

Weather and road conditions can change rapidly. Information displayed in the Service may not reflect current conditions due to delays in NWS publication cycles, forecast-model uncertainty, or rapidly changing weather.

You are responsible for your own safety. Do not rely solely on Traveler for critical safety decisions. Always:

  • Check official NWS, state DOT, and local news sources for the most current information
  • Obey all traffic laws, posted signs, and road closure notices
  • Use your own judgment about whether conditions are safe for travel
  • Pull over safely before using the Service while driving
  • Never use the Service in a way that distracts you from safe driving

Traveler is not a substitute for professional driving advice, official traffic management, or emergency services.

8. Intellectual Property

8.1 Our Intellectual Property

The Service, including its original content, features, functionality, design, and branding, is owned by wareOne LLC and is protected by copyright, trademark, and other intellectual property laws. Our trademarks, logos, and service marks may not be used without our prior written consent.

8.2 Third-Party Content

Weather data and alerts are sourced from the National Weather Service and are public domain. Precipitation radar imagery is provided by RainViewer and subject to their terms of use. Maps, directions, and base tiles are provided by Mapbox and subject to their terms of use. We do not claim ownership of third-party content but may display it as part of the Service.

8.3 Your Content

You retain ownership of any content you submit to the Service (such as saved routes or feedback). By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and display such content in connection with providing the Service.

9. Third-Party Services

The Service integrates with third-party services including:

  • Mapbox: Maps, geocoding, and directions
  • Stripe: Payment processing
  • National Weather Service (NWS): Gridded forecasts and active alerts
  • RainViewer: Animated precipitation radar tiles
  • Cloudflare Workers AI: AI-generated route briefings

These services have their own terms and privacy policies. We are not responsible for the practices of these third parties. Your use of third-party services through Traveler is subject to their respective terms.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

To the fullest extent permitted by law, we disclaim all warranties, including but not limited to:

  • Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
  • Warranties that the Service will be uninterrupted, error-free, or secure
  • Warranties regarding the accuracy, reliability, or completeness of any information
  • Warranties that defects will be corrected or that the Service is free of viruses or harmful components

We do not guarantee the accuracy of weather, alert, or hazard information. Data may be delayed, incomplete, or inaccurate. Use the Service at your own risk.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WAREONE LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, revenue, data, or goodwill
  • Personal injury or property damage
  • Business interruption
  • Any damages arising from your reliance on weather, alert, or hazard information
  • Any damages resulting from third-party services

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain damages. If these laws apply to you, some or all of the above limitations may not apply.

12. Indemnification

You agree to defend, indemnify, and hold harmless wareOne LLC and its officers, directors, employees, contractors, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your violation of any applicable laws
  • Any content you submit to the Service

13. Modifications to the Service

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

14. Changes to These Terms

We may revise these Terms from time to time. Material changes will be posted on this page with an updated "Last Updated" date. For significant changes, we may also provide additional notice (such as an email or in-app notification).

Your continued use of the Service after any changes indicates your acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Service.

15. Termination

You may terminate your account at any time by contacting us or through your account settings. We may terminate or suspend your access to the Service immediately, without prior notice, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service will cease immediately. Sections that by their nature should survive termination will survive, including ownership provisions, disclaimers, indemnification, and limitations of liability.

16. Governing Law and Dispute Resolution

16.1 Governing Law

These Terms and any disputes arising from them shall be governed by the laws of the State of Idaho, United States, without regard to conflict of law principles.

16.2 Informal Resolution

Before filing any formal dispute, you agree to first contact us at legal@511.travel to attempt to resolve the dispute informally. We will try to resolve the dispute within 60 days.

16.3 Jurisdiction

If informal resolution fails, any legal action shall be brought exclusively in the state or federal courts located in Ada County, Idaho. You consent to the personal jurisdiction of these courts.

16.4 Class Action Waiver

To the extent permitted by law, you agree that any disputes will be resolved on an individual basis, and you waive your right to participate in a class action lawsuit or class-wide arbitration.

17. General Provisions

17.1 Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices we publish, constitute the entire agreement between you and wareOne LLC concerning the Service.

17.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

17.3 No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

17.4 Assignment

You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights without restriction.

17.5 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, acts of government, or service provider outages.
